to: sdean12@sdean12.org Hello Sarah, I'd like to begin by saying that I'm not a lawyer. I have found your program in my search for a system that will allow me to share encrypted storage between MS Windows and GNU/Linux operating systems. When it comes to security applications I am extra picky about the licenses that govern any software that I use. It has come to my attention that your FreeOTFE license (http://www.freeotfe.org/docs/licence.htm) has some problems and I would like to suggest some solutions for those problems. It looks like your license has some ambiguous parts and is inconsistent as a whole. What does "I retain all rights to this software" mean? Does it include derivative works? The "etc." in this part is also quite ambiguous: "You use this software at your own risk, author takes no responsibility, etc (i.e. the usual disclaimers, etc.)" What are "the usual disclaimers"? The license says "I retain all rights to this software" but then it also says that "derived ... source code must be released into the public domain with full source code". To quote someone: "That is impossible, if the author of the derivative work (modification) doesn't have the copyright in the first place." These are just the problems that I and other people noticed in a short period of time. There might be others. Writing legal documents and especially good and clear licenses is difficult, but there are professional people who can help. I suggest that you read the GNU license list page (http://www.gnu.org/philosophy/license-list.html), GNU copyleft page (http://www.gnu.org/copyleft/copyleft.html), and then contact for further help. An even better alternative that I would personally love to see happen is re-licensing FreeOTFE under a Free Software (as defined by FSF: http://www.gnu.org/philosophy/free-sw.html) license such as GPLv3.(http://gplv3.fsf.org/). If you do this you still ensure your copyright ownership of the code as well as give people the freedom to use the software. I believe that your intention was to give people freedom when you wrote this license so GPLv3 would suit your purposes well. Thank you for your time and attention.
