|
|
It has come to the attention of OpenWrt.org that the most recent version of the OSWave firmware (OSWave 2.00R) contains kernel code from OpenWrt. OpenWrt is delighted that OSWave hereby recognizes the quality of the code developed by OpenWrt.
But, OpenWrt would like to request - also as a courtesy by OSWave towards their paying customers - that OSWave published the here concerned kernel sources.
OpenWrt does strongly believe in building and maintaining productive relationships, though such relationships have to be based on a both fair and positive basis.

| Well, charging $39.95 for the source isn't exactly fair, is it? |

OSWave claims the following license restrictions:
License Restrictions
You may not modify, adapt, translate, reverse engineer, de-compile, disassemble or unencrypt the software or parts of the software, or create derivative works based on the software. You may not modify, adapt, translate, or create derivative works based on the associated written materials. In no event may you transfer, assign, rent, lease, sell, or otherwise dispose of the software or your license information on a temporary or permanent basis. You are specifically prohibited from charging, or requesting donations, for this copy of the software and/or your license information, and from distributing the software, the software documentation and/or the license information.
Copy Restrictions
This software and the associated written materials are the subject of copyright. Unauthorised copying of the software or associated written materials, in whole or in part, is expressly forbidden. You may be held legally responsible for any copyright infringement caused or encouraged by your failure to abide by the terms and conditions of this license.
In as much as very large parts of the OSWave firmware consists of GPL'd software the above licensing terms would have to be seen as an infringement on the GNU GPL license requirements themselves.
OSWave offers binaries for download to everyone - to comply with GNU GPL and the rights of the individual to freely re-distribute, the source-code licensed under GNU GPL would also have to be made publicly available.
It would seem to be a simple matter to solve this un-desirable situation. Adding a complete source-code tar-ball of the GPL'd parts of the software to the download section of the website, or perhaps a few extra links would be a quick solution.

| The quick solution is available on the provided web page. You may not like it but it actually is more of your problem, than anyone else. |

It's not for the source, it's for the work required to provide it to you.
And it's completely ok with the GPL license so whether it's fair or not is out of the scope. |

| Just checking to see if there's any interest on cooperation beyond pure compliance. But since that doesn't seem to be the case, I'm going to leave you alone now. |
